This policy describes our approach to your personal data. Our privacy policy will be reviewed, and may be revised from time to time. You may wish to revisit it regularly.

We are doing our best to provide you through the TMM website/app with a great shopping experience which means that especially regarding the sensitive issue of the use of your personal data you can always trust us and our methods which are based on transparency and honesty. When using our services you agree that you are giving permission to TMM to use your personal data and in this privacy policy we will provide you with an understandable overview of what kind of personal data we use, for what reason and how we guarantee your protection as subject of that data. This policy is part of the Terms of Use which means that by accepting those you are also agreeing to our Privacy Policy. It is important to understand that this policy is TMM’s privacy policy and does not legally bind members of TMM community who also have access to your personal data, so that we are not responsible for the way the other users, and third parties, use your personal data. Make sure that you understand the privacy and security practices and policies of those parties before you make use of their services.

Types of personal data collected

Personal data, such as your name or a name related to your account and an e-mail address are required in order to register and create an account. You decide freely whether you wish to provide us with your personal data or not. If you provide us with this data on yourself, you thereby grant your consent for us to store and use it in accordance with data protection legislation. For further use of our services for example when you are purchasing an item, information like a valid physical postal address, billing name and address, bank account information, credit card information may be required to provide those services and deliver you the purchased item. In case you proceed to a purchase we do not store your credit card information. We do store a credit card identification token for requesting transaction through our payment provider’s API. In some cases you may be asked to authenticate your payment method when you place your order. To authenticate a payment, you will need to respond to a prompt from your card issuer and provide additional information, such as a correct response to a question, a password etc.

In case you set up a maker account, in order to establish your e-shop, TMM will require the following information regarding your business such as your full name, the name of your business, proof of your business through the official tax platform, your business’s Tax Identification Number, ID/passport copies, your date of birth, billing information, bank account number etc.

We also collect information about your use of the Services for advertising, for analytics, to serve content, and to protect the Services. This can include your IP address, browser information, device information and, when enabled by you, location information provided by your device.

If you are not a member and you do not have a TMM account but you are visiting our website and/or purchasing an item we are also obtaining information about you through automated procedures (e.g. your IP address) or you may provide us with information when subscribing to our newsletter (i.e. your e-mail) or a TMM member may provide us with personal information of yours in case of a gift card.

Security

We do our best to protect your personal information using the generally accepted industry standards. We use encryption to protect your personal identifiable information in browser – server communication using TLS (transport layer security).
Your account information is protected by a password (except for when you are using third parties’ logins such as facebook or instagram) which is one way hashed, meaning that when you enter your password it is encrypted in such a way that there is no way for someone to get back to the original input.

Collection & Use of Data

How we collect your data:

You may give to us directly personal information for example when you register to use any of our services as a maker, as a customer or even as a guest user, subscribe to one of our services or newsletters, purchase an item, report a problem with our site or request content or other information from us.

When you log in through other platforms and services (e.g. facebook or instagram) we also collect your personal data through their data base.

We also receive and record information from your browser or your mobile device automatically when you visit the website or use certain features of the Services, such as your IP address or unique device identifier, cookies, and data about which pages you visit and how you interact with those pages in order to allow us to operate and provide the Services. This information is stored in log files and is collected automatically. We also automatically collect device-specific information when you install, access, or use our Services. This information can include information such as the hardware model, operating system information, app version, app usage and debugging information, browser information, IP address, and device identifiers. How we use your data:

If you have provided us with personal data, we use it solely for the technical administration of our websites and for processing your requests based on that some of the e-mails that we are going to send you are required. For example you may receive e-mails regarding the update of our privacy policy, terms and conditions and other legal notices or you may receive e-mails confirming your purchase and regarding the process stage of your order, or other administrative service-related e-mails and notifications which are not optional. If you do not wish to receive such e-mails you can deactivate or delete your TMM account.

We also use this data for product-related surveys and marketing purposes, such as notifying you of new products, sending you newsletters but only if you have given us your prior consent. If you consent to your personal data being used for these purposes, it is used only within the TMM team. It is not disseminated to third parties, unless dissemination of it is required in execution of a contract or you have expressly consented to its dissemination. If you have not given your consent to this, the data is disseminated to third parties only if this is authorized by applicable legal provisions. Our employees, agencies and dealers are obligated to maintain data confidentiality.

You can control your Privacy Settings by selecting it from the menu of your Profile Settings.  Please note that some changes to your privacy settings may take a few days to take effect.

Legal basis for processing your data

We collect and use these categories of personal information only when having your consent for our business and commercial purposes described above, including providing and improving the Services, maintaining the safety and security of the Services, protecting vital interests of you and other members of the community, to processing purchase and sale transactions, and for advertising and marketing services.

Consent - We principally rely on your consent (which can be withdrawn at anytime) (i) to send marketing messages, (ii) for third-party data sharing related to advertising, and, to the extent applicable, (iii) for the use of location data for advertising purposes. By accepting the present privacy policy you have given us your consent to process your personal data for the purposes stated in this privacy policy. Before entering our website and using any of our services you are asked to agree with our privacy policy. You may also find additional information about the data we collect from your device automatically on our Cookie Policy page where you are also able to modify your cookie preferences.

Performance of a contract - We are processing your data in order to make it possible for you to use our services and optimize your shopping experience through our platform. For example we process your data when you place an order and we use your data to complete the purchase procedure or when you store items that you would love to check later on, to answer to your requests and questions, store the data of your account and make it accessible to you easily. The main function of TMM is to bring together the makers and the buyers through our website and enable the realization of the buying and selling procedure. Under this scope we facilitate the exchange of personal data between the members that are involved in each transaction. We may also disclose your personal data upon your direction and consent to third parties, such as our payment partners or the shipping partners of our makers to enable the completion of the transaction and provide you with our service. If you are a maker and receive personal data we expect you to respect the privacy of the member whose information you have been aware of and not use them for reasons other than completing the transaction through the TMM platform, as stated in our Terms of Use. No matter how the TMM is protecting your personal data the third parties (e.g. payment partners, makers and their shipping partners etc) have their own privacy policy and are responsible for the personal data they have received and have under their control.

Legitimate interest - We are processing your data relying on our legitimate interest to prevent harm to individuals, to safeguard our services from malware attacks and fraudulent actions, to crosscheck the authenticity of the member accounts, to enforce and defend any legal right of TMM, of the users of our services or our partners’. Using your information to improve our services by conducting researches, or asking you to submit a rating or a report of a product or a maker, using them for marketing purposes, are a few examples of our legitimate interest for the processing of your data making always sure that the processing has a minimal effect on your privacy.

Legal or judicial reasons - Your personal data may be shared with official public authorities or other governmental agencies for the purposes of a third party’s legitimate interest, to enforce legal rights, to protect our services and third parties from fraudulent actions enforced via our platform such as non authorized use of bank account. Using your data on that legal base stems also from our obligation to comply with legal obligations and court orders aiming to the protection of the public interest as well as of vital interests of third parties.

Your rights

You have the choice which information you would like to share with us and to what extend we are allowed to use it. Sharing specific information with us is essential for the fulfillment of our contract and your use of our services. However, this does not always require all the data which you can make available to us.

You can always exercise your rights stated as below and we are here to provide you with all the information you need. Please note that in order to perform the requested privacy policy related changes, it may take a few days for them to take effect.

Right to information - You have the right to be informed which data we store about you and how we process this data.

Right to rectification - If you notice that stored data is incorrect, you can always ask us to correct it or if you have access to the personal information related to your account you may make the changes you like through your Profile Settings.

Right to restriction of processing - If you do not wish to delete your data, but you want us to stop processing it further, you can ask us to restrict or limit the way we use your personal information. In this case, we will archive your data and only reintegrate it into our operative systems if you so wish. However, during this time you will not be able to use our services, otherwise we will process your data again.

Right to cancellation - You can ask us at any time to delete the data we have stored about you. We will fulfill your request in most cases except for information we are required to retain by law, regulation, or to protect the safety, security, and integrity of TMM. Upon deleting any data stored about you, you will not be able to use our services.

Right to withdraw consent - Our website offers you specific features which enable you to withdraw your consent to our processing of your information any time you desire, such as the Unsubscribe link in our newsletters or your Profile Settings.

Right to access and portability - You can access certain personal data through your Profile Settings. You can also request copies of your personal data which will be provided to you in a machine-readable format.

Right of complaint - In case you have any complaint regarding the way we handle your personal data you can complain to the supervisory authority stated below at any time:

Your requests regarding exercise of the above rights shall be answered within 30 days with no charge. When these requests are submitted electronically, we provide the information in a commonly used electronic form, unless otherwise requested. Although we provide the requested information free of charge, any additional copies and / or reprocess of the same request may incur a reasonable administrative cost. However, when the retrieval of the information is extremely complex or subject to valid delay, the time limit may be extended by 30 more days. In this case, we will officially notify you within 30 days stating the reasons for this delay.

Retention or how long we keep your data for

The data will be deleted as soon as it is no longer necessary for the purpose of its collection. This is the case during the registration process for the performance of a contract or for the performance of pre-contractual measures if the data are no longer necessary for the performance of the contract. Even after the conclusion of the contract, there may be a need to store personal data of the contracting party in order to comply with contractual or legal obligations. We will keep your personal data for as long as we need it for the purpose it is being processed for, depending on criteria such as the volume of your data, their nature, the purposes of the processing, our ability to achieve the purposes of processing your data using other lawful practices and without actually processing them. We will actively review the personal data we hold and delete it securely, or in some cases anonymise it, when there is no longer a legal, business or consumer need for it to be retained. We delete or block the personal data of the data subject as soon as the purpose of the storage is eliminated. It may also be stored if provided for by the European or national legislator in EU regulations, laws or regulations to which our company is subject. Blocking or deletion of the data also takes place when a storage period prescribed by the standards expires, unless there is a need for further storage of the data for conclusion of a contract or fulfillment of the contract.

In case you no longer want TMM to use your information to provide the Services to you and you close your account TMM will retain and use your information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your information to comply with applicable tax/revenue laws), resolve disputes, enforce our agreements, and as otherwise described in this policy. In addition, TMM makers may also be required to retain and use specific information of yours in order to comply with their own legal obligations. We also retain log files for internal analysis purposes. These log files are generally retained for a brief period of time, except in cases where they are used for site safety and security, to improve site functionality, or we are legally obligated to retain them for longer time periods.

Who else may have access to your data and why?

Third Parties - We cooperate with different data processors in our daily processing. These process your personal data in accordance with the requirements of Art. 28 GDPR only according to our instructions and have no claims whatsoever on these data. We also monitor our processors and include only those who meet our high standards. Because we use different data processors and change them from time to time, it is not appropriate to identify specific recipients of personal information. However, if you are interested, we will be happy to disclose the name of the processor(s) in use at that time upon request.

In addition to data processors, we also work with third parties, to whom we also transmit your personal data, but who are not bound by our instructions. These are, for example, our consultants, lawyers or tax consultants who receive your data from us on the basis of a contract and process your personal data for legal reasons or to protect our own interests. We do not sell or rent your personal data to third parties under any circumstances. This will never take place without your explicit consent.
Your data are also being processed by the maker that you choose to buy from.
We may require these third parties to follow our privacy and security requirements, but we do not control the privacy or security policies of such third parties and thus TMM is not responsible for the privacy or security practices of the makers, other users of our services and other websites on the internet, even those linked to or from or services. We encourage you to read the privacy policies and ask questions of third parties before you disclose your personal information to them.

Legal purposes - We may share your personal data in response to lawful requests by public authorities, including to meet legitimate national security or law enforcement requirements; to protect, establish, or exercise our legal rights or defend against impending or asserted legal claims, including to collect a debt, or a material violation of our policies (including our Intellectual Property Policy); to comply with a court order, legal process, regulation, or other legal requirement; or when we believe in good faith that such disclosure is reasonably necessary to comply with the law, prevent imminent physical harm or financial loss, or investigate, prevent, or take action regarding illegal activities, suspected fraud, threats to our rights or property, or violations of TMM’s Terms of Use. For example, if permitted due to the forgoing circumstances, your information may be shared with tax authorities or other governmental agencies. In the cases set out above, our use of your information may be necessary for the purposes of our or a third party’s legitimate interest in keeping our Services secure, preventing harm or crime, enforcing or defending legal rights, or preventing damage. Such use may also be necessary to comply with a legal obligation, a court order, or to exercise or defend legal claims or to facilitate the collection of taxes and prevention of tax fraud. It may also be necessary in the public interest (such as to prevent crime).

Necessary disclosures i.e. completing a transaction - If you are a customer keep in mind that the maker that you choose to buy a product from will independently process the data that you have provided them with through the TMM platform, such as your shipping address, which will also be shared with the shipping company/courier chosen by the maker to complete the transaction, your billing information which will also be shared with our payment partners who mediate the payment procedure. The makers and those partners mentioned above act as autonomous data controllers and have their own privacy policies and data processing and protecting measures. The disclosures stated above stem out from our Terms & Conditions and are necessary as a prerequisite for the fulfillment of our contractual obligations towards you. If you are a business and you want an invoice the data required for the issuance of your invoice (Tax Identification Number, address, profession) are also being used from the makers.

Other members may also see the date you joined; ratings, reviews and information relating to items you review, and related photos for items you purchased or sold; your profile information; items you listed for sale; your shop pages and policies; your Favorites, followers, and those you follow; sold item listings and the number of items sold; comments you post in our community spaces; and information you decide to share via social networks.

 

What to take care of if you are maker

If you are a maker we expect you to respect the privacy of the member whose information you have received. You can be informed on your responsibilities as a maker towards the data subjects in the Maker Policy. As described there you have a limited license to use that information and only for TMM-related communications or for TMM-facilitated transactions through the TMM website. TMM has not granted a license to you to use the information for unauthorized transactions or sending unsolicited commercial messages in violation of any applicable laws.

Privacy policy updates

We may amend or update our Privacy Policy from time to time. If such changes occur, we will let you know by doing one or more of the following: (i) posting the changes on on website, or (ii) sending you an email or message about the changes.

Profiling

TMM may also use first party data (e.g. your prior shopping and browsing activity on our website), and may combine it with other data collected from you, such as your location, or publicly available information, to permit us to create targeted suggestions based on your known or inferred demographic interests to provide you with more relevant content.
